You may be able to pursue a wrongful death claim when your spouse, child, or parent has died because of a negligent act.  A claim based upon Delaware’s Wrongful Death Act may arise from a car accident, motorcycle accident, truck accident, pedestrian accident, or construction accident.

Tiffany M. Shrenk represents individuals injured in wrongful death cases in Delaware courts.  Some of the wrongful death cases that she has been involved with included:

  • A wrongful death action field by a mother against a pediatric hospital for the death of her six-month old baby who died from septic shock as a result of the negligence of a pediatric nurse practitioner and nursing neglect.
  • A wrongful death action brought against a Delaware public school district for the failure to warn the parents of a high school student after his friends had notified the school counselor that the student was suicidal.
  • A wrongful death action by a surviving spouse and young daughter of a woman who died as a result of a misdiagnosis of deep vein thrombosis and pulmonary embolism following arthroscopic knee surgery.
  • A wrongful death action filed by the estate of a state prison inmate who died from liver failure as a result of a prison doctor’s over-prescribing of prescription medications.

In a wrongful death action, the damages that may be recoverable include:

  • Funeral expenses;
  • Mental anguish;
  • Loss of support contributions;
  • Loss of parental services;
  • Loss of marital services; and/or
  • Loss of household services
